Here’s a list of “fair use” situations for documentary films

This page provides four categories in which fair use applies to the making of documentary films. 

Each category includes examples of fair use under each category. Category examples listed in the linked article include “Employing Copyrighted Material as the Object of Social, Political or Cultural Critique” and “Quoting Copyrighted Works of Popular Culture to Illustrate an Argument of Point” (Center for Social Media).
